Facility Emergency Planning and Notification Requirements

SARA Title III Section 302

[Emergency Planning and Community Right-To-Know Act of 1986 (EPCRA)]

Requirements for Notification:
SARA Title III, Section 302 (b) provides that any facility which has an Extremely Hazardous Substance present at the facility in an amount at or in excess of the Threshold Planning Quantity (TPQ) established for that substance is subject to the notification requirements of SARA Title III, Section 302. In addition, the Illinois Emergency Management Agency may designate additional facilities which shall be subject to the notification requirements of SARA Title III, Section 302. An "Emergency Planning Requirement Determination" decision tree has been provided to assist you in determining if your facility is subject to the requirements of Section 302.

Who must you notify?
As soon as your facility becomes subject to the requirements of Section 302, you must notify, in writing, the Mason County LEPC:

Who is responsible for planning an emergency response plan for my facility?
As provided in Section 303 of SARA Title III, the Mason County LEPC is responsible for the preparation of an overall emergency response plan for Mason County. This plan includes individual emergency response plans for all of the facilities in Mason County which have notified the Mason County LEPC that they have a planning requirement under Section 302. Under the provisions of Section 303, each facility subject to Section 302 planning requirements must provide the LEPC with any information which the LEPC feels is necessary for the preparation of the emergency response plan. The facility is responsible for the collection and submission of this information to the LEPC.
